High Court in Nairobi has ruled that President Uhuru Kenyatta’s nominee to the South Korean Embassy Mwende Mwinzi can not be forced to renounce her American citizenship as it was acquired by birth.
Mwende had gone to court in September contesting Parliament’s recommendation to renounce her dual citizenship before she takes up the ambassadorial position. In her petition, Ms. Mwinzi sought orders to compel Foreign Affairs Cabinet Secretary Monica Juma to designate and post her to Seoul as the country’s envoy as she had complied with all the requirements for the position. In a ruling that was delivered on Thursday morning, Justice James Makau ruled that citizenship by birth can not be taken away by anyone. “I have no hesitation to agree that citizenship by birth cannot be taken away by anyone, ” He lamented.
